Agreement to these terms

These Terms of Service ("Terms") govern your use of getniceturf.com and the tools and features available on it, including our online yard measurement and instant quote tool (together, the "Site"). The Site is operated by Nice Turf LLC ("Nice Turf", "we", "us", or "our"), an artificial turf and landscaping company serving the Phoenix, Arizona metropolitan area.

By using the Site, submitting a form, or opting in to receive text messages from us, you agree to these Terms. If you do not agree, please do not use the Site.

You must be at least 18 years old and able to enter into a contract to use the Site or to request an estimate.

Use of the Site

You may use the Site to learn about our services, measure your own property, request an estimate, and contact us. We grant you a limited, personal, non-exclusive, revocable permission to use the Site for those purposes.

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Submit information that is false, or submit someone else's personal information, including a phone number that is not yours.
• Attempt to interfere with, disrupt, overload, or gain unauthorized access to the Site or the systems behind it.
• Use automated means to scrape, copy, or harvest content, pricing, or data from the Site.
• Reverse engineer or attempt to derive the underlying pricing rules or source code of the quote tool.
• Reproduce, resell, or commercially exploit any part of the Site without our written permission.

We may suspend or withdraw access to the Site, in whole or in part, at any time and without notice.

Estimates and the quote tool

The quote tool produces a PRELIMINARY ESTIMATE. It is not a binding quote, a contract, a formal bid, or an offer to perform work at the figure shown.

The estimate is generated from the outlines you draw on a satellite map, the surfaces and products you select, and the answers you give. Satellite imagery may be out of date, measurements drawn by hand are approximate, and a screen cannot show what is under the ground or behind a gate. The range you see is an educated starting point for a conversation, nothing more.

A firm price is provided only after we have assessed the property and put it in writing. The final price may be higher or lower than the estimate, and it may change once the site conditions are known. Factors that commonly move a price include:

• The actual measured area, which often differs from what was drawn on a map.
• Site access, slope, grading, and drainage.
• What has to be removed, and what is found underneath it, including concrete, roots, irrigation, and utilities.
• Material availability, product selection, and current supplier pricing.
• Permits, HOA requirements, and other local requirements.

Estimates are for the property you identify and are not transferable. Any figure shown is in US dollars and may expire or be revised at any time.

Services are subject to a separate agreement

Nothing on the Site creates an agreement for us to perform work. Any installation or landscaping work we perform is governed by a separate written agreement between you and us, which covers the scope of work, the price, the schedule, payment terms, warranties, and the rest of the terms that apply to the job.

If anything in that written agreement conflicts with these Terms, the written agreement controls for the work it covers.

SMS/Text Messaging Terms

Our SMS program

Nice Turf LLC sends two kinds of SMS, under two separate consents that are described below: transactional messages about a request you made, and promotional messages if you have opted in to them. Between them they cover appointment scheduling, appointment alerts, quote follow-ups, reminders, exclusive offers, and promotions. Messages are sent to the mobile number you give us, and some of them are sent by an automated system.

Message types

Promotional messages, which are the ones the optional checkbox covers: exclusive offers, promotions, reminders, and alerts.

Transactional messages, which the checkbox does NOT cover and which you agree to by submitting a form: appointment scheduling, appointment updates, appointment alerts, and quote follow-ups.

The two consents

There are two separate consents and they are not the same thing:

• Transactional messages, about the request you made: appointment scheduling, appointment updates, appointment alerts, quote follow-ups, and your project. You agree to these by submitting one of our forms, which says so at the button.
• Promotional messages: exclusive offers, promotions, reminders, and alerts. These and only these are what the separate optional checkbox covers. It is unticked by default and you only receive them if you tick it.

The forms carry a short summary of these terms at the point of consent. THIS SECTION IS THE FULL VERSION, and it is what those summaries link to.

CONSENT IS NOT A CONDITION OF PURCHASE. You do not have to agree to promotional messages to request an estimate, to get a quote, or to buy anything from us. Leaving the box unticked does not affect your request in any way.

Message and data rates

Message and data rates may apply. Those charges come from your mobile carrier, not from us.

How to opt out

Text STOP to opt out. You may receive one final message confirming that you have been unsubscribed. Opting out of text messages does not opt you out of email, and we may still need to reach you about an active project by another method.

Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and your device and cannot be guaranteed.

Eligibility

You must be 18 or older to opt in to SMS messaging. You also confirm that the mobile number you give us is yours and that you are authorized to consent for it. If your number changes or is reassigned, please tell us so we do not message the wrong person.

Your information

How we handle your phone number and your consent, including our commitment not to share them with third parties or affiliates for their own marketing, is described in our Privacy Policy.

Information you submit

You are responsible for the accuracy of what you submit, including your contact details, the property address, and the outlines you draw. We rely on that information to prepare an estimate and to contact you about it.

By submitting information through the Site, you grant us permission to use it to respond to you, to prepare and follow up on an estimate, and to perform and improve our services. Our handling of personal information is described in our Privacy Policy, which is part of these Terms.

Intellectual property

The Site and its contents, including the text, layout, graphics, photographs, logos, the Nice Turf name and marks, and the software behind the quote tool, are owned by us or our licensors and are protected by copyright, trademark, and other laws.

You may view and print pages from the Site for your own personal, non-commercial use in connection with considering our services. Any other use, including copying, republishing, distributing, or creating derivative works, requires our prior written permission.

Map imagery, mapping data, and related features are provided by Google and remain the property of Google and its providers. Your use of those features is also subject to Google's own terms.

Third party services and links

The Site relies on third party services, including Google Maps Platform for mapping and address lookup, and it may link to sites we do not operate. We are not responsible for the content, availability, accuracy, or practices of third party services or sites, and a link is not an endorsement.

Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE". To the fullest extent permitted by law, Nice Turf LLC disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, or error free, that measurements, imagery, or estimates will be accurate or complete, or that any defect will be corrected.

This section does not limit any warranty we give in a separate written agreement for work we actually perform.

Limitation of liability

To the fullest extent permitted by law, Nice Turf LLC and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost data, or loss of goodwill, arising out of or relating to your use of the Site, including reliance on any estimate it produces.

Our total liability for all claims arising out of or relating to the Site is limited to one hundred US dollars ($100). Liability for work we perform is governed by the separate written agreement for that work.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing here limits liability that cannot be limited by law.

Indemnification

You agree to indemnify and hold harmless Nice Turf LLC from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your misuse of the Site, your violation of these Terms, or your submission of information you were not authorized to provide, including a mobile number that is not yours.

Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of those courts.

Changes to these terms

We may update these Terms from time to time to reflect changes to the Site, our services, or the law. When we do, we will revise the effective date at the top of this page. Continuing to use the Site after a change means you accept the updated Terms, so please check back from time to time.

We may also change, suspend, or discontinue any part of the Site, including the quote tool, at any time.

General

If any provision of these Terms is found unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
